Terms of Service

Draft, not yet reviewed by a lawyer. These terms describe how the product actually behaves, but they have not been read by Indian counsel.

1. What you are buying

You are buying advertising placement on a public leaderboard. Position is ordered by total spend and can be taken by anyone who spends more, at any time, without notice.

You are not buying a review, an endorsement, a rating, a certification, traffic, clicks, customers, or any position for any period. Appearing on a board is not our opinion of what you are advertising. We do not verify the claims, prices or quality of anything listed. Click and visitor figures describe what our systems recorded, and are not a prediction of what you will get.

2. Who may buy

You must be at least 18 and able to enter a contract. If you are buying for a company, you confirm you are authorised to bind it, and “you” means that company as well as you.

3. The Rules are part of these terms

The Rules describe how boards, pricing and listing limits work, and form part of this agreement. If the Rules and these terms disagree, these terms apply.

4. Rank is assigned at payment confirmation

Your listing goes live when the payment provider confirms the payment, not when you begin checkout. Another buyer may confirm a higher amount in the meantime, so you may land at a lower position than the one you aimed at. That is inherent to the product and is not a defect.

5. Payments and tax

Checkout is processed by Dodo Payments, acting as merchant of record. For the payment itself Dodo is the seller: it adds applicable tax at checkout, collects and remits that tax, issues the invoice and sends your receipt. Dodo's own terms and privacy notice apply to the payment.

The figure shown before you pay is the placement amount, and it is the only figure that decides your position. Tax sits on top of it and never affects where you rank, so two buyers charged different tax for the same placement amount hold the same position. Card details are collected by Dodo, never by us, and we never see or store a card number.

6. Refunds and cancellation

Placement begins immediately on confirmation and is consumed continuously, so payments are not refundable. Being outranked, a listing removed for breaking the Rules, choosing the wrong category or amount, or traffic below your expectations do not create a refund. By completing checkout you ask us to begin immediately. Where a consumer right cannot be given up, we honour it.

These are the cases we do put right:

  • Duplicate charges. Charged twice for the same claim, we refund the duplicate in full.
  • Payment taken, listing not live. If a confirmed payment did not produce the placement it should have, we either apply the placement or refund it.
  • Listings created without authorisation. If someone listed your business without permission we remove it at no cost to you.

Write to us with your order reference, which starts with rk_. We acknowledge within 48 hours and aim to resolve within one month, and we can send a copy of the invoice for any payment on request.

7. What you may list, and what you promise us

You may only list something you own or are authorised to represent. By submitting a listing you confirm that it and its destination are lawful, that you are not impersonating anyone, that you are not claiming a position for a competitor without their permission, and that what you have told us is accurate.

You will cover our costs, including reasonable legal costs, for claims arising from a listing you created, its destination, or your breach of these terms.

8. Names, logos and metadata we display

To show a listing we read and display information published by the destination itself: its name, title, description, icon, and social preview image. We use that material only to identify what a paid position points at, and we claim no affiliation with, sponsorship by, or endorsement from the owner unless the owner is the person who listed it. This is identification use under section 30 of the Trade Marks Act, 1999 and fair dealing under section 52 of the Copyright Act, 1957.

You grant us a non-exclusive, royalty-free licence to store, cache, resize and display your listing and that published information for as long as we run the board. If you want a listing taken down, tell us. Removal does not reverse a completed payment.

9. Our rights, and reporting a listing

We may refuse, hide, recategorise, correct or permanently remove any listing, pause checkout, and reverse a position arising from a chargeback or a failed payment. Removal for breach does not create a refund. We may publish aggregate figures about listings, including spend, clicks and visits.

If a listing infringes your rights, misuses your name, or points somewhere unlawful, write to our grievance officer with: who you are and how to reach you; the listing on this site; the destination it points at; what is wrong; and a statement that your notice is accurate and that you are the rights holder or authorised to act. We may restrict the listing while we look at it, and we may pass your notice to the person who created it. If someone has listed your business, profile or venue without permission we remove it at no charge, and you do not need to outspend anyone.

10. Chargebacks

If a payment is charged back, the corresponding spend is deducted and the listing falls accordingly. Raising a chargeback instead of contacting us is a breach of these terms, and repeated chargebacks may result in a permanent block.

11. Availability, and changes

The service is provided as it is. It may be unavailable, slow or wrong. We may change boards, pricing, categories or these terms. Material changes are reflected in the date at the top of this page, and continuing to use the site means you accept them. For a payment already made, the terms in force when you paid govern that payment.

12. Disclaimers and liability

To the extent the law allows, we exclude all implied warranties, and we do not promise that the site will be uninterrupted or that listings, images, positions or counts are accurate or complete. We are not responsible for the destinations listings point at, which have their own terms.

We are not liable for lost profits, lost business or other indirect loss. Our total liability for any claim is limited to what you paid us in the 30 days before it arose. Nothing here limits liability that cannot be limited by law.

13. Complaints

14. Governing law, and general

These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute arising from them.

If any part of these terms cannot be enforced, the rest still applies. Not enforcing something once does not waive it. You may not transfer these terms without our agreement; we may transfer them if the service changes hands. These terms, the Rules, the privacy policy and what you confirm at checkout are the whole agreement between us.

15. Who you are contracting with

Two parties, deliberately stated separately. The advertising placement is provided by the business below, which is who you are contracting with for the service and who answers everything on this site. The payment is sold and invoiced by Dodo Payments as merchant of record, which is why your receipt and invoice come from them rather than from us.
